Nevada Public Records

Nevada State is popular for being an open record state. It has long made provisions for sharing the state’s records with the general public. The state makes it very easy for the public to requesting for an obtaining these records.

Nevada law dictates that all public records and books of any government body must be made accessible to the general public, unless they have been legally and specifically declared as confidential. Anyone can ask for Nevada public records, and the purpose for making the request need not to be stated. However, there are some few limitations on access to some records whereby a person making a request to obtain them needs to have a court order or to give a proof that they are a journalist.

Nevada Criminal Records

Nevada background checks are handled by the Nevada Department of Public Safety, General Service Division. The Central Repository for Nevada Records of Criminal History is where fingerprints are stored.

Arrest records are not available to everyone. Only conviction records can be obtained by anyone without any kind of waiver or credentials. Complete criminal records are only accessible by the subject of the record. Authorized state agencies, law enforcement agencies and approved employers are the only third parties allowed to request criminal records.

Information regarding current arrest records and current inmates in Nevada is available to the general public. The information is limited to the name, age, gender, known aliases, skin color, weight, height, birth date, ethnicity, eye color and hair color of the inmate. Research results will also provide you with the inmate’s current place of incarceration and their previous convictions if any.

Only the inmates and authorized third parties can access jail and inmate records, and sentencing and conviction information. Family members can also obtain this information at the facility where the inmate is currently being held.

Nevada Court Records

Every county in Nevada maintains for all courts within their borders or jurisdiction. You can obtain court records from the Clark County (Las Vegas) Clerk of the Court. The records are available from the Eighth Judicial District Court since 1909 to date. The courts of Lincoln County contain the court records filed prior to 1909. Many records from 1990 onwards are available online. To obtain records prior to 1990, you will have to submit your request by mail or in person at the Regional Justice Center in Las Vegas.

Nevada Vital Records

All Nevada’s vital records for birth and death certificates issued from August 1911 are available at the Office of Vital Records of the Nevada State Health Division, which is located in Carson City.

  • Birth records: A statewide registration of births was enacted in the state of Nevada in 1911. Before this time, there had been some counties recording for births. These records are available at the Nevada Department of Health and Human Services. All birth records from 1911 to present are available at the Nevada State Library and Archives.
  • Death records: Death records in the state of Nevada are managed in the early-1911 category and 1911-present category. The birth records in the 1911-present category are collected yearly at the Nevada Department of Health and Human Services. All death records from the early-1911 category were gathered from the Nevada State Library and Archives.
  • Marriage records: Statewide registration of divorce in the state of Nevada began in 1968, but even before then, many counties had been keeping records of marriage in earlier years. Microfilmed copies of these early records of marriages are available at the Family History Library. Marriage records for Washoe County from 1862 to 1872 are available at the Nevada State Library and Archives.
  • Divorce records: Even though many Nevada counties had been keeping divorce records in the earlier years, the state registered a statewide registration of divorce in 1968. To obtain divorce records, you need to direct your request to the county where the final decree was granted.

The trial court system of Nevada State consists of Municipal Courts, Justice Courts, and District Courts.

District Courts

The Nevada District Courts have general jurisdiction to handle all types of criminal and civil cases. However, they usually handle only the cases that other Nevada courts have no jurisdiction over.

Typical criminal cases that Nevada District Courts hear include juvenile cases, family law cases, cases related to neglect and abuse, and general civil cases claims involving more than $10,000 in dispute. Typical criminal cases that these courts hear include lesser-included offenses, gross misdemeanors, and felonies.

District Courts have Family Court divisions. Every Family Court division has jurisdiction to handle certain types of cases, including involuntary hospitalization, divorce, juvenile matters, parentage and abuse prevention. A Family Court division shares jurisdiction with a District Court over claims for damages arising from domestic violence.

Justice Courts

Nevada Justice Courts have exclusive jurisdiction to handle certain types of criminal and civil cases. General criminal cases that these courts hear include misdemeanors. Typical civil cases that Nevada Justice Courts hear include majority of general civil cases with less than $10,000 in dispute, exclusive of interest. Besides, these courts also handle other types of civil claims that fall within the financial limits, including some liens, landlord-tenant, and collection actions for taxes, forfeitures, penalties, or fines.

In addition, each Justice Court also has a simplified Small Claims procedure or process for some types of civil claims for amounts in dispute falling within financial limits.

These courts also hear some cases that involve orders of protection against stalking, orders of protection against harassment at workplace, orders of protection against home or domestic violence. These courts have no authority to handle cases involving mining claims, disputes over title or boundaries to real estate, or disputes over validity of a fine or tax or assessment.

Municipal Courts

The Nevada Municipal Courts have exclusive jurisdiction to handle certain types of criminal and civil cases.

Civil cases that these courts handle include some tax collection, actions to stop nuisances, violations of municipal ordinances, and other types of civil claims for below $2,500 which are brought by the agents of the city or by the city itself. Typical criminal cases that these courts handle include misdemeanor violations of town or city ordinances. They also hear other violations of the municipal ordinances.

Municipal Courts have no authority to handle claims connected to the validity of a levy, tax or assessment. They also cannot hear claims involving the title to real property.
