Nebraska Public Records

Nebraska has a population of about 1.8 million residents and it has long had provisions for the sharing of public records with the general public.

First passed in 1975, the Nebraska Public Records Law, which is covered in Section 712 of Chapter 84 in the State Revised Statute, gives the public the ability to access state’s public records. The law dictates that “all citizens and any other individual interested in seeing the public records can request to access them. The reason for applying to examine the documents doesn’t have to be stated and there are no restrictions on how the records may be used once obtained.

Records covered under the Nebraska Public Records Law are records from all public entities, including the judicial, legislative, and executive branches. The records that are exempt include:

• Trade secrets
• Medical reports
• Personal information
• Law enforcement records
• Security-related searches
• Public retirement records
• Credit information
• Employment records
• Archeological records

Nebraska Criminal Records

The Nebraska State Patrol is responsible for administering the state’s criminal history records. These are known as Nebraska Records of Arrest and Prosecution (RAP). The searches are fingerprint-based. This means that citations and traffic violations are not included.

Anyone can request RAP sheet on anyone through an online portal or a request form. To make your request, you will need to have the individual’s full name and the exact date of birth.

Arrest records, jail and inmate records are also subject to the Nebraska Public Records Law. Any information regarding inmates in the service, correctional facilities, and services for victims in the state can be found at the Nebraska Department of Corrections website. To locate an offender, simply go to a search page where you will enter the offender’s Last and First Name or DCS Id. The search will give you the offender’s current location, status, earliest possible release date, and offense information.

Nebraska Court Records

For any information regarding the courts and court records in Nebraska, simply visit the state’s administrator of the courts website. You can search for court records online through JUSTICE court case database, which gives access to civil, traffic, criminal, probate, and juvenile cases filed in all district and county courts. You can be able to get case detail, registrar of actions, court cost information, and parties involved. To obtain full case files copies, you will need to apply with the clerk of the court of the appropriate courthouse.

Nebraska Vital Records

Vital Records in Nebraska, such as marriage, divorce, birth and death, are under the maintenance of the Nebraska Department of Health & Human Services, Office of Vital Records. Access to these records is limited to persons whose names have been included in the certificates, a relative, or a legal guardian.

The trial court system of Nebraska State consists of Workers’ Compensation Court, Juvenile Courts, County Courts, and District Courts.

District Courts

The Nebraska District Courts have general jurisdiction to handle all criminal and civil cases but typically handle only those cases that other courts have no jurisdiction over.

Criminal cases that these courts hear include lesser-included offenses and felonies. Civil cases handled by these courts include general civil cases involving more than $53,000 in dispute. The District Courts financial jurisdiction limit on civil claims is usually reviewed every fifth year. This therefore means that the financial limit on the civil case jurisdiction may vary.

County Courts

The Nebraska County Courts have exclusive jurisdiction to handle certain types of criminal and civil cases, including general civil claims, domestic relations, juvenile, and probate.

Civil cases that County Courts hear include general civil claims for up to $53,000. The financial limit on civil claim jurisdiction is usually reviewed after every five years and may sometimes vary over time. County Courts have Small Claims divisions for handling most general civil claims that fall under certain financial limits.

Criminal cases generally heard by these courts include most violations of village and city ordinances, infractions, and misdemeanors.

Nebraska County Courts have limited jurisdiction over all probate matters, except when a will contest has been transferred to the District Court upon the request of all or one of the parties. These courts have jurisdiction over conservatorships, most guardianship, and juvenile cases except when the county has a separate Juvenile Court.

Nebraska County Courts share jurisdiction for certain types of cases with District Courts. These cases include some domestic relations matters.

Juvenile Courts

Currently, Nebraska has separate Juvenile courts in three counties. One is in Sarpy County, another one is located in Lancaster, and the third Juvenile Court is in Douglas.

Workers’ Compensation Court

The Nebraska Workers’ Compensation Court has jurisdiction over cases connected to workplace illnesses and accidents. Workers’ Compensation judges move throughout the entire state to hear claims that workers or employers have made under the Worker’s Compensation Act. The court has statewide jurisdiction.

Court Notes

Most Nebraska districts and counties have Problem-Solving Court special programs. These programs can establish treatment in lieu for imprisonment for some offenders who have substance abuse problems. Nebraska Problem-Solving Courts include a DUI/Drug Treatment Court, Young Adult Drug Court, Adult Drug Court, Family Drug Courts, and Juvenile Drug Courts.
