Mississippi Public Records

Mississippi has a population of about 3 million residents and it does make clear provisions for sharing the state’s public records with the general public.

The Mississippi Public Records Act came into force in 1983. Prior to this time, there was common law access to the state’s public records due to a 1941 court decisions. The present public records act is enacted in Chapter 6 of Title 25 of the Mississippi Code. It states that “any person” may access public records of Mississippi State. Provided the records are not in any way of confidential nature, it is not a must that the purpose of requesting is stated. The records can be used for any purpose once obtained. Records included in the Act include all files that public bodies, such as the executive, judicial, and legislative branches, produce. However, the judges, legislators, and executives themselves are exempt.

Mississippi Criminal Records

The responsibility of administering background checks in the state of Mississippi is given to the Department of Public Safety, Criminal Information Center. Background checks are performed for the purposes of criminal justice investigations, pre-employment checks, and licensing. You need a court order or a signed for you to request any of these reports. The reports are also fingerprint-based. Therefore, before requesting any of these reports, a fingerprint scan must be completed for every applicant.

The trial court system of Mississippi State consists of Municipal Courts, Justice Courts, Youth Courts, County Courts, Chancery Courts, and Circuit Courts.

Circuit Courts

The Mississippi Circuit Courts have general jurisdiction to handle most criminal and civil cases, but only handle cases that other courts have no jurisdiction to handle. They also handle appeals from administrative agencies, Municipal Courts, Justice, and County.

Criminal cases that these courts hear include lesser-included offenses and felonies. They hear all civil claims involving more than $200,000 in dispute, and certain matters connected to real estate. They may share with County Courts jurisdiction over cases for less than $20,000 in dispute.

Chancery Courts

Mississippi Chancery Courts have exclusive jurisdiction over certain types of cases such as guardianship, mental health, equity, probate matters, domestic relations, and matters connected to real estate.

The Chancery Court judges act as Youth Court judges to preside over juvenile matters in counties where a County Court is not available.

Typical cases that these courts hear include involuntary commitment, child support, the probate of wills, alimony, administration of estates, divorce and legal separation.

County Courts

Mississippi County Courts have exclusive jurisdiction to handle certain types of criminal and civil cases. They share jurisdiction over petty misdemeanors and other criminal cases with Justice Court.

They have limited jurisdiction to handle juvenile matters, whereby the County Court judge is the one who preside of the case at a Youth Court. County Courts also handle most general civil cases for less than $200,00o in dispute, exclusive of interest and costs. They also can handle cases involving partition of private property, eminent domain, and some actions involving unlawful detainer or entry.

Youth Courts

The Mississippi Youth Courts have jurisdiction over all cases involving a dependent child, an abused child, a delinquency child, a juvenile offense, and a neglected child. There are 21 Mississippi counties with County Courts. In these counties, the County Court judge also acts as a Youth Court judge. Chancery Court judge is also the Youth Court judge in counties where there is no County Court.

Justice Courts

These courts have exclusive jurisdiction to handle certain types of criminal and civil cases. General criminal cases heard by these courts include petty misdemeanors and criminal offenses that are punishable by a time in county jail or fine. These courts also conduct preliminary and bond hearings in felony cases. The civil cases these courts handle include general civil cases with less than $3,500 in dispute.

Municipal Courts

Mississippi Municipal Courts have exclusive jurisdiction to handle certain types of criminal and civil cases. Criminal cases these courts hear include municipal ordinance violations and misdemeanor criminal cases.

Court Notes

Most courts in Mississippi operate special Veteran Court, Mental Health Court, and Drug Court programs that can establish treatment in lieu of confinement for some offenders who have mental health or substance abuse problems.
