Louisiana Public Records

It’s important to note that the political subdivisions in Louisiana are known as parishes and not counties as other U.S. states. The state makes most of the government records available to the public.

The Public Records Act gives the public the right to access Louisiana government records. First passed in 1940 and revised in 1974 and in 1978, the Act is found under the Louisiana state statute in Title 44. According to the law, “any person of the age of majority” can be granted access to public records in Louisiana State. The purpose of making the request and what the records will be used for once obtained is not relevant. However, convicted felons must disclose the reason why they are requesting for the records.

Records covered under the Act include any record of a state’s public body, including legislative bodies, executive offices, and certain parts of the state judiciary system. The records that are exempt include:

  • Medical records
  • Trade secrets
  • Security records
  • Law enforcement-related records
  • Employer information

Louisiana Criminal Records

The administration of background checks in the state of Louisiana is the responsibility of the Louisiana State Police, Bureau of Identification and Information. Many background checks in Louisiana require a signed consent from the person to be checked. You also cannot run a background check as a private citizen on anyone else. Licensing agencies, school districts, and employers have numerous options through which to request a background check. One option is to submit a completed form, with a signed consent, along with fingerprint card to the state’s Bureau of Identification and Information. Alternatively, they can make their request through an online background check portal if they qualify.

For all arrest records and jail and inmate records, you can visit the website of Louisiana Department of Corrections. This is where you will find information on all offenders in the Louisiana state system, the correctional facilities, or for victim services. You can locate an offender by doing an online search at Vincelink.com where the search will provide you with the present location, the earliest release date, and a list of all charges of the offender. You can also locate an offender through 225-383-4580, which is an automated number that will prompt you to enter the DOC Number of the offender and you will obtain their current status.

Louisiana Court Records

Any information about courts in Louisiana State is available at the website of the state’s administrator of the courts. There is also the Law Library of Louisiana which is an online search where some court cases in the state can be located. However, you will still have to request most court records from the courthouses in which the cases were heart.

Louisiana Vital Records

The State Registrar & Vital Records administers death and birth certificates in Louisiana. To obtain marriage or divorce certificate, you must make your request to the specific clerk of the court office in the parish in which the marriage or divorce took place.

  • Birth records: A statewide registration was officially signed into law in early 1911 and the Louisiana Vital Records Registry keeps birth records from this timer to present. But some counties and churches began registering for births as early as 1790. Orleans Paris for example, began keeping records of birth in 1790. Other parishes also started keeping records of birth in the late 1800s and the Louisiana Office of Public Health keeps these records.
  • Death records: Death records prior to 1904 exist in the state of Louisiana. They had been recorded by the parish, church, and clerks’ registers. Death records from 1911 to present are available and you can request for them from the Louisiana Vital Records Registry.
  • Marriage records: Marriages were initially recorded in Louisiana by each parish. Apart from marriage records from Orleans Parish that are kept at the Office of Public Health, all other original parish marriage records are available at the various clerks’ offices of the court in every parish. Marriage licenses from 1870 to 1915 are available at the Louisiana Family History Library.
  • Divorce records: The parish court of the Orleans Parish and Louisiana district courts were given the jurisdiction to handle divorce cases in 1827. You can obtain these records from Louisiana Family History Library. The Louisiana Legislature presided over divorce proceedings from 1805 to 1846 and you can find printed copies of these records as the Legislative Calendar.

Access to Louisiana government records is a constitutional right. Just make your request appropriate and you will easily get access to the information you are looking for.

Louisiana Courts Overview

To make your work easier, start searching for court records in Louisiana by simply going to the Louisiana courts by Parish.

The trial court system of Louisiana State consists of Mayor’s Courts, Justice of the Peace Courts, New Orleans Traffic Court, New Orleans Municipal Court, City Courts, Parish Courts, Juvenile Courts, Family Court of East Baton Rouge, and District Courts.

Louisiana District Courts

Louisiana District Courts general jurisdiction to handle all types of criminal and civil cases, but typically handle only those cases that other courts have no jurisdiction to handle. They have limited jurisdiction over majority of cases that involve property, and felony crimes. In East Baton Rouge Parish, Family Court has exclusive jurisdiction over the cases that involve partitioning of community property.

District Courts may also have Magistrate, Domestic, Juvenile, Family, Civil, Criminal, and Drug Court sections or divisions.

District Courts share jurisdiction with Parish, City, Traffic, and Municipal Courts for some offenses related to driving while under the influence. ?Orleans Parish Criminal District Court supervises Traffic and New Orleans Municipal Courts, and Orleans Parish District Court supervises New Orleans City Courts.

Louisiana Juvenile Courts

The Juvenile Courts of Caddo, Orleans Parishes, Jefferson, and East Baton Rouge have limited jurisdiction to handle certain types of cases, including adoption proceedings that involves individuals under the age of 17, and juvenile delinquency acts committed by individuals under the age of 17. These courts share jurisdiction over some child support cases with District Courts.

Family Court of East Baton Rogue

This court has limited jurisdiction to handle all actions for child support and child custody, annulment, divorce, alimony, incidental family matters that may arise in East Baton Rouge Parish, and division or partition of community property.

Parish Courts

Louisiana Parish Courts in Jefferson Parishes and Ascension have exclusive jurisdiction over some types of criminal and civil cases. They share jurisdiction with District Courts over some civil cases, including general civil cases that involve disputes over values of property or amounts of money within the certain financial limits.

They share jurisdiction over some types of criminal cases with District Courts. These cases include violations of municipal, parish, or state laws, if the offense is not punishable by more than 6 months imprisonment or by a fine not exceeding $1000. They may also share jurisdiction over certain juvenile cases and matters with District Courts.

City Courts

Louisiana City Courts have exclusive jurisdiction over some types of criminal and civil cases. These courts have replaced Justice of the Peace and Mayor’s Courts in some locations. Typical criminal cases that these courts handle include cases that don’t require any trial by jury and crimes that are not actually punishable by hard labor.

General civil cases that these courts handle include general civil cases that involve disputes over values of property or amounts of money within particular limits.

City Courts may have Small Claims division to handle most general civil cases with claims less than $3000 in dispute, excluding fees, penalties, costs and interest, when the defendant waives their right to an appeal or a jury trial. They may also hear some juvenile cases.

New Orleans Municipal Court

This court has limited original jurisdiction to hear violations of city ordinances, with exceptions of traffic violations that are heard by the New Orleans Traffic Court. It shares jurisdiction over violations of the state laws that don’t require any trial by jury with Orleans Parish Criminal District Court.

New Orleans Traffic Court

It has limited jurisdiction to handle violations of traffic ordinances within the City of New Orleans. The court shares jurisdiction over violations of state vehicle and traffic laws that don’t require any trial by jury with New Orleans Parish Criminal District Court.

Justice of the Peace Courts

These courts have exclusive criminal and civil jurisdiction that might vary by court. General criminal cases handled by these courts include preliminary hearings for majority of criminal cases as well as litter violations, and sometimes non-felony criminal cases and certain types of violations.

They share exclusive jurisdiction with District Courts over certain civil cases, including certain civil cases with claims in dispute within financial limits. These cannot hear some types of cases, including cases involving title to real property, cases where political subdivision or Sate is a defendant, and probate matters.

Mayor’s Courts

Louisiana Mayor’s Courts handle local ordinance and traffic violations, and have the authority to impose court costs, probation, fines, and imprisonments. These courts are available in most municipalities except in areas with a City Court.
