Colorado Public Records
According to the provisions made by the government of Colorado the residents of the state of Colorado have the right to obtain and copy most of the records.
The public records law of the state of Colorado is known as the Colorado Open Records Act. The Act dictates that all government records and information are made available to members of the public. Records covered include all documents and information maintained by the government at all levels, including legislative, executive, and judicial branches. Also covered are records produced, maintained, or acquired by any agency or organization that receives funding from the government.
Exempt from the Colorado Open Records Act are records that violate the privacy of a person, security related records, trade secrets, records made confidential by the statute or court, and records that may compromise public safety or an ongoing investigation if released.
Colorado Criminal Records
Criminal records checks in the state of Colorado can be done with simple background checks that provide such information as arrest records, arrest warrants, jail and inmate records, and juvenile criminal records. The search also gives sex offender listing, misdemeanors, felonies, probation records, and parole information.
The Colorado Open Records Act makes arrest records, and jail and inmate records available to the public. Information regarding Colorado correctional facilities and inmates in the system as well as services to the victims and their families is available at the Colorado Department of Corrections website.
Colorado Court Records
All the records produced in any court in Colorado are considered public records, with the exemption of the information sealed by the court or state statute. To obtain court files and any information on court opinions, you can visit the state’s administrator of court website.
Colorado Vital Record
The Colorado Department of Public Health and Environment all records regarding death, birth, divorce and marriage in the state of Colorado. You can obtain birth certificates online, via email or fax, or in person by visiting any local county office.
- Birth records: Birth records catalog in the state of Colorado is divided into two categories. The categories include birth records prior to 1907 and birth records from 1097 to present. The law requiring towns and counties in Colorado to record births was passed in 1976. Such birth records are available at the appropriate local courthouse. The statewide registration of births began in 1907. The Colorado Department of Health keeps birth records from 1907 to present.
- Death records: Death records in Colorado are organized into two categories: The first category comprises of records from early 1900, which were collected from the clerks’ offices and church registers. Death records from 1900 to present are available at the Colorado Department of Health, which is where you can request the records from.
- Marriage records: To obtain records of marriage from other years, make your request at the local county office where the certificate was issued. Marriage records are available within the state from 1900-1939 and from 1975 to present.
- Divorce records: Divorce records are available within the state from 1851-1939 and from 1968 to present. You can request for divorce records from 1968 to present from the Colorado Department of Health.
The Colorado Open Records Act gives you the right to access and obtain copies of most records held by the government of Colorado. Just make your request appropriately and look at the right places.

Understanding what Colorado state court system consists of is very important especially when trying to find court records. This post shows the court systems in Colorado and where to find the court records.
Colorado Courts Overview
The court system in Colorado State consists of Denver County Juvenile Court, Denver Probate Court, Water Courts, Municipal Courts, County Courts, and District Courts.
You may begin searching for court records by going to courts in Colorado by county.
Colorado District Courts
Colorado District Courts generally have jurisdiction over all criminal and civil cases, but usually handle only the cases that other courts have no jurisdiction over.
Criminal cases that District Courts handle handled include lesser-included offenses and felonies. The civil cases handled by these courts include general civil claims for any financial amount. They also hear domestic relations, paternity, adoptions, juvenile matters, probate matters, and mental health cases.
Typically, cases heard by these courts include divorce cases and other related cases such as division of marital property, child support and child custody.
These trial courts share jurisdiction with Municipal Courts and County Courts over domestic violence protection orders.
Colorado County Courts
County Courts form part of the Colorado trial court system and they have jurisdiction over certain types of criminal and civil cases. Criminal cases typically handled by these courts include petty offenses, preliminary hearings for criminal cases, and misdemeanor.
Civil cases typically handled by these courts include most general civil cases involving claims less than $15,000, exclusive of ownership of real property. All landlord-tenant cases involving a monthly rental value of below $15,000 are handled by County Courts.
County Courts have a Small Claims division for handling most general civil cases involving less than $7,500 in dispute. However, Small Claims Division has no jurisdiction to hear certain kinds of cases including claims for slander, defamation, libel, forcible entry, unlawful detainer, forcible detainer, criminal matters, traffic violations, certain types of contract cases, most types of injunctive relief, and class action lawsuits.
These courts share jurisdiction over requests for permanent and temporary civil restraining orders and name changes with District Courts.
They don’t have jurisdiction over cases that involve legal separation, annulment, divorce, matters that involve children, matters that involve disputes over title to real property or boundaries, mental health, and probate issues.
Colorado Municipal Courts
Municipal Courts form part of the Colorado court trial system, and they have jurisdiction over violations of town and city ordinances. They share jurisdiction over cases that involve civil Protection Orders with District Courts.
Colorado Water Courts
Just like the name suggests, Water Courts have exclusive jurisdiction over most cases related to water, including the administration and use of water, and water rights.
Colorado Denver Probate Courts
Denver County has a separate Probate Court, which is sometimes known as the 24th District Court. The court hears probate cases of City and County of Denver.
Colorado Denver County Juvenile Court
Denver County also has a separate Juvenile Court that hears most juvenile matters that could have otherwise handled by the District Court.
